Terms and Conditions
Bayhunt provides customers with restricted access rights for personal use on this platform, prohibiting any downloads or modifications to its content. Access is intended solely for personal purposes and not for commercial exploitation, including the collection and use of product listings, descriptions, or pricing information. Additionally, any derivative use of the platform or the application of data mining, robots, or similar tools is strictly forbidden. Reproduction, duplication, sale, or any commercial exploitation of the platform's content is not permitted without explicit written consent from Bayhunt.
Customers are also prohibited from using framing techniques to display any trademarks, logos, or proprietary information, including images, text, page layouts, or forms, without prior written consent from Bayhunt. Any unauthorized use will result in the immediate termination of the access rights granted by Bayhunt.
PART 1 - ELIGIBILITY FOR REGISTRATION
Individuals may register for the offered services if they possess the legal capacity to enter into a contract. According to Section 11 of the Indian Contract Act, 1872, a person is deemed competent to contract if they have reached the age of 18, are of sound mind, and are not disqualified from contracting under any applicable law.
PART 2 - DELIVERY AND HANDLING CHARGES
Bayhunt reserves the right to apply delivery and handling charges, as well as taxes, periodically.
While Bayhunt strives to meet the expected order fulfillment timelines, the actual delivery duration may vary from the initially indicated timeframe at the time of order placement. Any delays in delivery will be promptly communicated by Bayhunt.
PART 3 - ORDER CANCELLATION
A customer may choose to cancel an order within one hour of placement, whether made online or via our customer service, and will receive a refund of any advance payment made. This policy does not apply to Express delivery orders, as they are processed and dispatched without delay. To prevent any claims related to damage post-delivery, customers are advised to examine the product seal prior to accepting the order.
Bayhunt retains the authority to cancel any order at its discretion, particularly in cases of product unavailability or if there are suspicions of fraudulent activity by the customer or violations of the platform's terms and conditions.
PART 4 - RETURN & REFUNDS
Bayhunt is committed to ensuring customer satisfaction and upholds a "no questions asked" return and refund policy for any quality or freshness concerns regarding its products. Customers are entitled to request a refund or replacement within 24 hours of product delivery if they encounter any quality issues.
6. Product Quality and Safety
We ensure that all products offered via the App meet the highest quality and safety standards. Upon delivery, please inspect your products. Any complaints regarding the quality of the products must be raised within 5 hours of receipt.
If we approve your cancellation:
- Refunds are processed within 48 hours
- Money is credited back to your account within 5-7 working days
The method of refund will be determined by Bayhunt periodically, which may include crediting Bayhunt Wallet or returning funds to the original payment method. However, due to the order value and the complexities associated with cash on delivery transactions, refunds will typically be applied to future purchases or credited to the customer's Bayhunt Wallet account.
PART 5 - CUSTOMER ACCEPTANCE
I hereby agree upon:
- Agree to cover additional costs incurred by Bayhunt for redelivery due to incorrect name, address, or other erroneous information provided during the order process.
- Utilize the platform solely for lawful transactions, adhering to all relevant laws and regulations.
- Commit to providing accurate and truthful information at all times, granting Bayhunt the authority to verify this information and deny registration if any details are found to be partially or wholly false.
- Acknowledge that accessing services and purchasing products on the platform is done at my own risk, exercising sound judgment as a knowledgeable customer.
- Confirm that the delivery address submitted is accurate and appropriate in every aspect.
- Ensure that product descriptions are thoroughly reviewed prior to placing an order and agree to comply with the terms and conditions of sale.
- Accept responsibility for any price differences arising from weight variations at the time of delivery or agree to adjust excess payments against future orders.
- Understand that Bayhunt reserves the right to amend policies and procedures as necessary.
- Acknowledge that failure to comply with these terms may result in restrictions on access to the platform and its services.
PART 6 - OBLIGATIONS OF VISITOR / CUSTOMER
I hereby unconditionally undertake not to use the Platform for:
- Prohibition against sharing objectionable content, including harassment, libel, abuse, threats, or any illegal activities.
- Restriction on transmitting materials that may constitute a criminal offense or lead to civil liability, violating laws or regulations.
- Unauthorized access to other computer networks is strictly forbidden.
- Interference with another individual's right to use or enjoy the platform is not permitted.
- Disruption of networks or websites associated with the platform is prohibited.
- Unauthorized reproduction or storage of copyrighted materials without Bayhunt's consent is not allowed.
- Posting reviews that infringe on third-party rights, including copyright and privacy, is prohibited.
- Comments containing unlawful, threatening, or obscene content, as well as spam, are not acceptable.
- Misrepresentation through false email addresses or impersonation is strictly forbidden.
- Users are responsible for their submitted feedback and must indemnify Bayhunt against any claims arising from it.
PART 7 - CUSTOMER FEEDBACK & REVIEWS
If you provide specific materials, such as contest entries, at our request, or share creative ideas, suggestions, proposals, or other content without our solicitation—whether online, via email, postal mail, or other means (collectively referred to as 'comments')—you grant us the unrestricted right to edit, copy, publish, distribute, translate, and utilize any comments you submit in any medium at any time. We are not obligated to (1) keep any comments confidential; (2) compensate you for any comments; or (3) respond to any comments. Although we may choose to monitor, edit, or remove content that we deem unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, we are not required to do so. You affirm that your comments will not infringe on any third-party rights, including copyright, trademark, or privacy rights, and will not contain any unlawful, abusive, or obscene material, nor any malware that could disrupt the Service or related websites. Misleading us or third parties about the origin of your comments, including using a false email address or impersonating someone else, is strictly prohibited. You are fully responsible for the comments you make and their accuracy, and we disclaim any liability for comments made by you or any third party.

To opt out of receiving future marketing or sales communications from us, please follow the steps outlined below. PART 9 - PRICING
The prices shown for all products on our mobile application (iOS and Android) do not include GST. The prices applicable at the time of ordering will be the ones charged on the delivery date, with the exception of fresh food items. Should the prices of fresh food items differ on the delivery date, any necessary adjustments will be made, resulting in either additional charges or refunds at the time of order delivery.
PART 10 - IMAGES AND HUES
Bayhunt has exerted considerable effort to present the products and their colors on the platform with the utmost accuracy. However, Bayhunt does not guarantee or assume responsibility for discrepancies in the visual representations of fresh foods or color variations that may arise due to technical factors.
PART 11 - RIGHT TO MODIFY TERMS & CONDITIONS OF SERVICE
Bayhunt retains the absolute right to alter the terms and conditions governing transactions on the Bayhunt platform without prior notice or customer consent. By accessing the Bayhunt platform, a registered customer is considered to have accepted the most current version of the Terms & Conditions available on the site.
PART 12 - GOVERNING LAW AND JURISDICTION
Any disputes arising from or related to business conducted on the platform shall first be addressed through amicable discussions and negotiations between the involved parties. If these attempts do not resolve the issue, the dispute may be referred to arbitration. The arbitration will be conducted in English and will take place in Chennai. The decision made by the arbitral tribunal will be final and binding on both parties, with no right to appeal to any court. Exclusive jurisdiction for any disputes, differences, or claims arising from this agreement will be held by the courts of competent jurisdiction in Chennai.
PART 13 - COPYRIGHT & TRADEMARK RIGHTS
The Customer understands that accessing this platform does not grant any rights or licenses related to the intellectual property of Bayhunt or any third party.
Bayhunt retains all intellectual property rights associated with the text, programs, products, processes, technology, content, and other materials available on the Platform.
All rights, including copyright, related to this platform are owned by Bayhunt.
Any use of this platform or its contents, including reproduction or storage in any form, is strictly prohibited without prior permission from Bayhunt.
Bayhunt holds all trademarks, service marks, product and service names, design marks, and slogans linked to its offerings.
References to third-party names, marks, products, or services on the Bayhunt Platform, as well as links to third-party sites, are provided solely for customer convenience and do not imply Bayhunt's endorsement or recommendation of those third parties or their products.
Bayhunt disclaims any responsibility for the content of third-party sites and does not guarantee the accuracy of the materials found there. Customers who choose to visit third-party websites do so at their own risk.
All materials hosted on the Bayhunt platform, including images, text, illustrations, designs, icons, photographs, programs, music clips, video clips, and other content (collectively referred to as "Promotional Material"), are provided for the convenience of customers.
The software utilized on the Bayhunt platform is owned by Bayhunt or its licensees and is protected by copyright laws.
The contents and software on the Bayhunt platform are intended solely as a shopping resource, and any other use, including reproduction, modification, distribution, transmission, or display of the contents, is strictly prohibited.
All contents are protected by copyright, trademarks, and other intellectual property rights.
PART 14 - OBJECTIONABLE MATERIAL
Although robust IT security measures are in place to ensure that only appropriate and socially acceptable content is available on the Bayhunt platform, the customer understands and accepts the inherent risk that they may encounter content that some may deem offensive, indecent, or objectionable while using this platform or any services provided on https://bayhuntseafoods.com, even if such content is not explicitly marked as such.
Bayhunt and its affiliates will not be responsible for any content that the customer may find offensive, indecent, or objectionable.
PART 15 - INDEMNIFICATION
As a Customer, I agree to defend, indemnify, and hold harmless Bayhunt, along with its employees, directors, officers, agents, and their successors and assigns, from any claims, liabilities, damages, losses, costs, and expenses, including attorney's fees, arising from my actions or inactions. This includes any losses or liabilities faced by Bayhunt or third parties due to breaches of warranties, representations, or obligations outlined in this User Agreement, as well as violations of applicable laws and regulations, such as Intellectual Property Rights, statutory duties, claims of libel or defamation, infringements of privacy or publicity rights, service disruptions to other subscribers, and other rights.
This provision will remain in effect even after the expiration or termination of this User Agreement. Bayhunt reserves the right to terminate this User Agreement at any time without prior notice or liability.
